Abstract The fundamental right of scientific freedom requires that its subprinciple of homogeneity is not only applied in connection with the concept of the material professor but also consistent with the model of the collegiate professor. While the former distinguishes the genuine scholars entitled to scientific freedom from the remaining teaching persons in university, the latter separates them from their fellows, who are identically qualified on an academic basis but predominantly serve management and administrative functions in the university's everyday work. According to the concept of the collegiate professor, scholars are only attributable to the group of scientific freedom carriers if they primarily perform tasks in research and teaching. Unlike them, fellows, who exclusively or mainly fulfil management and administrative duties, do not qualify for the group over the course of their term of office. During this period, they lack the possibility of representing the typical perspective of the scholars in group university, because they possess a divergent standardised range of interests, a different function in the university's everyday work and a substantially limited degree of independence. In this context, the fact that they possess an identical status in terms of civil service law is of no relevance. (HRK / Abstract übernommen)
